26/11 case may see India’s first terror trial under new in-absentia law
- A Mumbai court has started proceedings against six Pakistan-based accused in the 26/11 Mumbai terror attacks, including Hafiz Saeed and Zaki-ur-Rehman Lakhvi.
- The court directed all six accused to appear by August 18, but the trial can continue even if they remain outside India and do not appear.
- The case could become India’s first terror trial in absentia under Section 356 of the Bharatiya Nagarik Suraksha Sanhita BNSS.
- The provision allows courts to try and deliver judgments against proclaimed offenders who continue to abscond, without requiring their physical presence.
